Nissan won the M battle with BMW

In Canada on a court battle BMW has failed to prevent Nissan from using the letter ‘M’ for what BMW pictured as its rival’s “inferior and more modestly priced” cars. Several months ago BMW originally won an injunction and stopped Nissan from using the letter.

The difficult part is proving that there was a trademark violation but BMW won’t stop from appealing. In Munich the officials didn’t object to Nissan using the letter for the Infiniti “M35″ and “M45″. Only when the Japanese carmaker ran a publicity action in Canada, which stated “the M is coming,” they decided to stop.
The only option now for BMW is to reach an agreement with Nissan or petition to the Supreme Court.
